1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Subscriber," "you," or "your") and SignalStack Media LLC ("SignalStack," "we," "us," or "our"), a limited liability company organized under the laws of Delaware, with its principal office at 1209 Orange St, Wilmington, DE 19801.

By accessing our websites, subscribing to our newsletters, or using any of our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

2. Services

SignalStack operates a portfolio of niche intelligence newsletters. Our services include free and paid newsletter subscriptions, web-based content, data access, and API services (collectively, "Services").

3. Subscription and Account

To subscribe, you must provide a valid email address and, for paid subscriptions, valid payment information. You represent that you are at least 18 years of age and that all information you provide is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials.

4. Paid Subscriptions

Paid subscriptions are billed on a monthly recurring basis. All prices are in U.S. dollars (USD) unless otherwise stated. Applicable taxes will be added at checkout.

You may cancel your paid subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods, except as required by applicable law. We reserve the right to change subscription pricing with 30 days' written notice.

5. Intellectual Property

All content provided through our Services is the property of SignalStack Media LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use our content for your personal or internal business purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit our content without our prior written consent.

6. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. The information provided in our newsletters is for informational purposes only and does not constitute legal, financial, investment, or professional advice.

7. Limitation of Liability

To the maximum extent permitted by applicable law, SignalStack Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.

8. CAN-SPAM Compliance

We comply with the U.S. CAN-SPAM Act. By subscribing to our newsletters, you provide express consent to receive commercial electronic messages from SignalStack Media LLC at the email address you provide.

Every commercial electronic message we send will: (a) identify SignalStack Media LLC as the sender; (b) include our physical mailing address; and (c) include a functioning unsubscribe mechanism. Unsubscribe requests are processed within 10 business days.

9. Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use our Services will immediately cease.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the federal and state courts located in Delaware.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify subscribers of material changes by email or by posting a notice on our website at least 30 days before the changes take effect.
